These Terms of Use ("Terms") govern your access to and use of the website and rental services of GDW Trailer Rentals, LLC ("we," "us," "our"). By using our website, reserving equipment, or renting from us, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Eligibility

To reserve or rent, you must be at least the minimum age we require, have a valid government-issued driver's license or ID, and provide accurate information. We may require proof of insurance and may decline or cancel a rental at our discretion where permitted by law.

2. Reservations, quotes & payment

• Prices, availability, and quotes shown on our website are estimates and may change until a reservation is confirmed.
• You authorize us (through our payment processor) to charge the rental fees, applicable taxes, delivery or other fees, and any security deposit to your payment method.
• A security deposit may be held or charged and is released or refunded after the equipment is returned and inspected, less any amounts owed under these Terms.
• We may charge your payment method on file for additional amounts you owe, such as late fees, cleaning, damage, loss, fuel, tolls, citations, or recovery costs.

3. Rental period & returns

The rental period is the time stated in your reservation or agreement. You must return the equipment on time, to the agreed location, and in the same condition you received it (normal wear excepted). Late returns may incur additional charges, and equipment not returned may be reported as stolen.

4. Use of the equipment

• Use the equipment only for its intended purpose, lawfully, and in line with any instructions, weight ratings, and safety guidance we provide.
• Do not exceed rated capacities, operate the equipment unsafely or while impaired, sublease or lend it to others, remove or tamper with any identifying marks or tracking devices, or take it outside any area we specify.
• You are responsible for proper towing, loading, securing of loads, and safe operation, and for any drivers or operators you allow to use the equipment.

5. Care, damage, loss & theft

You are responsible for the equipment while it is in your possession. You agree to pay for repair or replacement of equipment that is damaged, lost, stolen, or returned in unacceptable condition, and for related costs (such as towing, recovery, and loss of use), subject to applicable law. Report any accident, damage, theft, or breakdown to us promptly.

6. Cancellations & refunds

Cancellation, change, and refund terms are as stated at the time of booking or in your rental agreement. Some fees may be non-refundable. Where we cannot fulfill a confirmed reservation, your remedy is a refund of amounts paid for that reservation.

7. Assumption of risk & release

Renting and operating trailers, equipment, and related items involves inherent risks. To the fullest extent permitted by law, you assume those risks and agree to use the equipment at your own risk.

8. Insurance

Unless we state otherwise in writing, we do not provide insurance for your use of the equipment or for your property or cargo. You are responsible for maintaining any insurance required by law or appropriate for your use.

9. Indemnification

You agree to indemnify and hold harmless GDW Trailer Rentals, LLC and its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the equipment or your breach of these Terms, except to the extent caused by our own gross negligence or willful misconduct.

10. Disclaimers

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, GDW Trailer Rentals, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or loss of use, arising out of your use of the equipment, website, or services.

12. Privacy

Your use of our website and services is also governed by our privacy policy and, if you receive texts from us, our text message policy.

13. Changes to these Terms

We may update these Terms from time to time and will post the updated version here with a new date. Your continued use of our website or services after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the state in which we operate, without regard to conflict-of-law rules. Any dispute will be handled in the courts located there, unless applicable law provides otherwise.
